Well this past week and a half sucked. I was in MO on my way to Layd N the Park and 20 minutes into my trip I was in an accident. It was a two lane road and the guy comming from the other direction took a left hand turn right infront of me. I had 2 witnesses and the other dirver got the citation for the accident. My real pain was my BMW was totalled. Now they only want to give me cash value of a 92 BMW in good condition. They are not willing to pay for the $$$$ of aftermarket parts that are on it. I haven't settled with them but figure someone else has had a problem with this and is there any law that might help me out. I am from FL so I had to buy a plane ticket to get my butt home and I missed the show. If someone needs more details let me know but just throwing this out here to see if there is hope.

just wondering if you kept any of the receipts of the work done on the BMW?

yeah I got the receipts, most of it is supension parts. They are claiming that well this doesn't mean it increased the value of the vehical.

Sorry to hear about this but your insurance is probably gonna not pay. There is a very specific claus in you contract that usaully says something like no coverage on motified suspension and clearcoat paint. So unless you contact them prior to an accident or a theft and add it to the vehicle then your probably screwed! I know I went through this all when my truck got stripped in front on my house airride and all. First the accused me of fraud and then refused to pay.

My buddy wrecked his honda civic and he got state farm to pay him $6000 for the body kit, wheels and labor. They were even his insurer and it was his fault. I wouldn't settle right away, insurance companies always low ball you first.

Can you go after the insurance company of the person at fault for the accident. I f you get them to pay for it they might pay for it all. Especially if they want to keep a lawyer away.

is the other guys insurance the ones paying? there is a possibility of sueing them, but if its your ins company you wont get anything unless your custom stuff was insured. state farm is one of the best companies out there because they will insure your custom stuff at a percentage of what its worth each month, like 10 dollars a month for each 1000 dollars of work or something like that. my buddy had some old lady pull out of a driveway and hit him from the side while he was driving down a road, the old ladys ins company didnt pay, so state farm paid to have all his paint and bodywork fixed, then turned around an sued the old ladys company.

If it is geico or progressive have fun they are two of the worse ones we deal with at our body shop. The law are different state to state. In Idaho it just depends on how much you fight. Paint and body work they dont like paying for but aftermarket stuff depends on what it is. Alot of people will take the stuff off that the insureance people dont want to pay for. Good luck and stick to your guns.

ive got state farm and they are pretty cool. girl who rearended me a few years ago had state farm too. they just told me to go get 2-3 estimates of what it would cost to fix it and they cut me a check for everything (including the custom bodywork). i got pretty lucky though. you don't hear of that happening very often. not sure why i got lucky.
