hows it going fellas, got a quick question for some legal advise for any one who has delt with this situation.. I parked my truck on the side of the road outside my girlfriends house. Overnight her neighbor had backed into me and dented up my third door. The damage isnt too bad,the door still works, but i want it fixed. So i knocked on her door and she gave me her information and told me to call her when i had a quote to get it fixed. Being the nice guy that i am, i went with trying to go the cheapest route, i went to a junk yard and found a not so perfect third door, and asked my body guy just to hang it and paint it. Well now the lady that i thought was so nice is not calling me back. I showed up at her house and "she wasn't home". Im starting to get really frustrated with this whole thing. My question is what can i legaly do?? Take her to court? I mean its been about 3 weeks now and im sick of lookin at a dented door. thanks in advance

I am no lawyer but without a police report or statement of fault think you are sunk. Good luck and hope it turns out.

James, file a report even being this late. It may be worth a shot if you got her info and all. Or just ride down to the police department and talk face to face with someone. They are typically more willing to help if you find them, and they dont find you.

need a police report! but you can always try small claims court. very unlikely she'll lie under oath (well, most people dont!)

You can file a police report as long as you have someone that can verbaly state that the accident and the situation took place. (an eyewitness to the damage)... the five-o will talk with this woman of course. Her word to fix it is a verbal contract of sorts. You will probably have to take her to small claims (50 bucks), and prove this of course, and if you win, you can ask for that fee back.

did you get her insurance info? if so just call them. when my neighbor backed into my truck i got their info even though they didnt want to give it to me, called the insurance and set up a claim.. no police report or anything.

If you have none of her insurance info, just go past her house and get her license plate number. Then call your insurance company and file a claim. If possible, you may want to take picture of any damage on HER car, before you try to make a claim incase she trys to deny it and/or gets her damage fixed.

I dont know how things work in Florida, but in North Carolina you only have 72 hours to file an accident report, and then you need both parties and vehicles at the same place to make the report...
at this point I'd say you have to take her to small claims court without a report, just document everything as best you can (take pictures of the damage, location you were parked, her driveway, everything you can think of)
