i sold my 4runner almost 3 months ago for cash down plus he had to pay me each month.i am the leinholder on the title and have a notorized document we both signed stateing that i can repo the vehicle after 3 missed payments (will be may 20)my questions are 1. does anyone know how i can get my name back on the title as owner and get him off since he broke the agreement.2. if i repo it am i required to give it back if he comes up with the cash? caus i dont wanna have to do this same crap again in 3 months, just wanna resell it cheap this time.

oh yeah and by the way its a 94 2WD 4runner, it may be for sale soon for cheap.

anybody know what i can do?
all ive been told is to take it to small claims court but i dont want to take him to court, at this point i just want the 4runner back to resell for cash up front!

seems like you should've talked to a lawyer even before selling to the guy.

i talked briefly to an unhelpful attorny today and he asked if we had a written agreement that we both signed and i do so that seems the be the one thing that could screw me if i didnt have, but i also have a lien on the vehicle like a bank would so he obviously can never sell it but i'd still like to just get it back and resell. seems all the lawyers are business lawyers, dui, and marriage. so i dont know how to get in touch with the type of lawyer i need.

go to civil court, show the judge what has happened, then if he wishes, he will file a junction for a cop to acompany u to their house for the repo.

after you have done the repo, go down to your dmv, and file for loss of title, it'll take up to 6 weeks for a new title to come in.

if the guy comes up with the money after u have done this, tell him tough shit, in the agreement he was three months behind, u told him ud come and get the truck if he was late after three months, and sell it to some1 else. thats how these low budget car places do it. late even ONE payment, they get it......

Whats up bro, im a police officer and from what the way it sounds to me matt is right you will have to take him to court to work it out. Just make sure to bring all documents and anything having to do with the sale of the truck... Good luck... Police will not get involved in civil matters except for a quick civil standbye to make sure no criminal problems happen..
