To make a long story short I sold my truck in 08 and bought it back last April. I had to have it shipped across country and when I recieved itthere wwere damages that the guy did not disclose to me. I still owe him some money on the agreement that I did not send due to the issues. On top of that he stil had a balance on the loan he got when he purchased it from me. It's been a year, I haven't heard from him at all but have a truck I can't register or drive. What can i do? Even if I was to pay the entire remaining amount I agreeed to (despite the damages) The loan still needed a grand from him to pay it off and release the title....I wrote him an e-mail monday stating all the facts and the problems and told him that I need a response by the 12th or I will have to take other measures to obtain legal ownership.....What can those measures be? what are my options if I don't hear from him? can I not pay him the amount I agreed to since he misrepresentated the quality of the vehicle? ( I have proof in e-mail)Any help would be greatly appreciated. Trucks about to be painted and ready to hit the scene again and after all the rebuild and fixing I have done over the past year it kills me that it's so nice out and I can't go cruising!

Your biggest issue going forward will be the lien on the title. Regardless of how much you paid the owner, what agreements you had and so on, until that lien is taken care of, you can never own the truck. Now, once that is squared away, you have many options if the previous owner refuses to give you the title. Mechanics liens (May differ state to state, but in NC its possession for 6 months), you also have the option of bonding the truck and getting a title, which essentially is paying a fee to say that the truck isn't stolen, yet you have had possession for X amount of time with no hope of getting a title.

Regardless, you need to figure a way to clear the lien that's existing, or there is nothing you can do to legally obtain ownership.

1) Easiest, go to the dudes house, have him drive you to the bank, pay the dudes loan off, get title. Cost $1000 + plane ticket.
2) Have the shop thats working on it put a lien on it, pay for all the costs, transfer title from their name into yours. Lots of paperwork and you have to be real friendly with the shop owner. Cost around $600 by me but takes months.
3) Trailer queen for the rest of its life.

so the guy acually replied.
He isn't stepping up to acknowledging the damages...not even the 5 cut marks in the rag top!
I offered to split the difference I owe him, 500 bucks. Hopefully he takes it cause I really don't want to pay out the 1000 bucks especially since I've been working on it all year fixing his "repair work"...he re-wired the cab with damn house wire! he plumbed in two more compressors without a pressure switch and used shop air hose!
Granted, even if I have to pay the full grand to get the title released I'm still up 3K after what i sold it to him for.
Thanks for the input guys. Plain tickets from Cali to florida arn't the cheapest so I don't think I can do that one...plus my wife would be pissed if I took off for a couple of days considering our daughter is only 9 days old

Stop emailing the guy and send him a certified letter with return receipt requested.

You need to talk to a lawyer and get some legal counsel. Have your bill of sale and any other documentation ready.

You are going to run into an issue with you not paying what you said you would pay, but you do have valid argument with saying that he did not truthfully disclose the condition of the truck, but all he has to say is he did, if the bill of sale says "as is", then it is "as is. If it's not in writing it didn't happen.

You could also contact the bank, and have them move his loan to an unsecured or charge off loan, but you are going to have to prove that you own the truck now. Be as tactful as possible when dealing with the bank, they are being screwed over on this deal also.

Never got a bill of sale.
But I do have all our correspondance from myspace messaging clearly stating what he claimed the condition was. and also my responses stating what was wrong when my guy went to pick it up as well as when it was delivered.
I think I'm just going to have to sack up and pay the grand. sucks cause it takes away from the rebuild budget...but having atitle is priceless i guess.
I thought of buying another ranger extended cab, any year and just using the papers for both trucks...lol. but that's kinda shady and don't want to deal with that. of course I would put the vin from the other truck on my bodied truck...but still. I was the second owner and I guess now the fourth, lol. I would lose all the history of it...plus vin cloning is a costly game if caught.

your most likely screwed all the way around, and id contact the lien people.

screw paying dipshit any more money.

take care of the lien, and then file for abandoned title .

its not like the guy is down the road in your town, so to him you have paid him, and its out of sight out of mind,


id start posting on here to see if anyone knows him, and get some people to go talk to him and tell him what a dipshit hes being.

How would I take care of th Lien holder without paying the 2k on his loan?
I was thinking of putting a title inquiry out there and hopeing nobody claims it....
Anyone have a lawer I could chat with? I told him I'd at least like him to cover the ragtop damage...so we'll see. Morethan likely I'm going to have to pay the G I originally said I would, sucks, but it sucks more to have a truk I can't drive on the streets.

Dude you need to hope he actually used the money you gave him to pay down the note. The lien holder still has a security interest in the truck even though you bought it. Technically they could come repo the truck from you.

I would not pay anything else to him. Contact the lien holder and see how much is outstanding on the loan. You might get lucky and they might release their security interest on the truck, but they really have no incentive to.

FOR OTHER PEOPLE BUYING TRUCKS. DON'T BUY A TRUCK WITH A LIEN ON IT UNLESS THE LIEN HOLDER IS WILLING TO RELEASE THEIR SECURITY INTEREST IN THE TRUCK. YOU CAN END UP HAVING TO PAY DOUBLE FOR THAT TRUCK. ALSO IF YOUR PURCHASE MONEY IS SUPPOSE TO GO TOWARD PAYING OFF THE LIEN, DON'T PAY IT TO THE SELLER, GIVE IT TO THE LIEN HOLDER.
