Got rear ended today!!

damn some dumbass didnt see i stopped at the redlight and rearended my ass in a brand new impala.

i seem fine, besides im starting to feel a little back pain. but im wondering what to do about my truck. the damage isnt too bad, the tailgate needs to be replaced, has a dent on the bottom and also my driver side bed got a crease right on the wheel fender, like the bed wanted to crumble.

how should i go about insurance not fucking me over, i got the tailgate shaved, a smooth rollpan that kinda cracked a little at the welds and shaved rocker guards on my side bed panel. my truck is saint black, but i got primer spots on it from shaving stuff...anyway i can get a paint job out of this? any suggestions????

His insurance has to fix the truck back to the way it was before he hit you. If you backed into someone they usually dont fix the custom stuff unless its in your policy. If you know someone at a shop or find a cool shop they may be able or willing to throw a paint job on it for ya at not extra cost or very minimal cost.

i was at a redlight and he rammed into me. i didnt hear any tire screeching and their wasnt any traffice, i was sitting at the lights for a few sceonds too. so all his fault completely.

also dont worry about the custom stuffbecause the factory prices for bumpers and etc. more than cover the cost of a roll pan and welding it in

if your bed has buckled then you have a good bit of damage

also the price for a new tailgate will cover you finding another used one (or new) and shaving it as well

as far as a new paint job thats up to the shop and you probably have to pay extra on top of the insurance check to have the truck painted

His insurance company will send an estimater. They will cut you a check with some paper to sign stating it closes your claim. It is up to you to get it fixed, so basically you get cash and like everyone else is saying factory parts are usually more expensive. You can try to fight on the custom stuff by getting your own estimate to fix it in writing and submitting that to his insurance company if you are not happy with their estimate. Yeah, I've been through this a couple times now.

if you are having back pain from this i would seriously advise going to a doctor for it. You should talk to their insurance, tell them you are having pain and you want to go to a doctor. If they dont agree its time for a lawsuit. I found myself in the same situation. I was rearended when i was a junior in high school and I had big time back problems out of it. I had physical therapy on my back 3 times a week for 5 months and the person that rearended me their insurance paid for it all. unfortunately i still have occassional back problems related to the wreck but seriously man, go to the doctor.

yea, i dont advise frauding the insiurance company but the best thing to do is: get 3 estimates from shops of your choice, preferably the three most expensive shops in town, then go to the hospital, get a doctor to fill out and sign a document stating what, if anytyhing is wrong with you, this is a way to maximize your insurance check, although i disagree with it completely, it will get you the most money. the reason for 3 estimates is that if theirs is way off they wil have to take the estimated average of the 3 quotes, granted its a descent insurance company. he rearended you and no matter when that happens they are at fault. good luck.

well the insurance adjuster came and the dude was a total moron!

he claims the side bow wasnt caused by the accident, WTF? i told him he knows nothing of bodywork and hes just here to take pictures so take the pictures of the damage and leave. he said the crack from the top of the rolpan wasnt caused by the hit, cuz it had a little rust...its been raining the last week and it was surface rust, i told him hes an idiot, and i didnt want to put primer on the bare metal because i didnt want to mess with the damage til my bodyshop estimated everything. I told the adjuster i have custom bodywork and the tailgatre needs to be completely replaced and shaved and he said ":i dont see no tailgate hangle? where is it?" i told him it was shaved off and he said "wheres the holes, i dont see anything where a tailgate was" i was like "cuz it was an epensive bodywork, so good u cant tell" that tells you how much of a moron the adjuster was, couldnt even see a handle was shaved or one is suppose to be tere, he said he has 35 years experiance bodywork and that bow wasnt caused by te accident, i told him he needs to go back to school cuz all he is a photgrapher so take the damn pictures and go home and read about bodywork.
