The weber 38 is the ideal size carb for a strictly performance application, drag racing, circle track, alison legacy series that sort of stuff. You really need to have several performance mods done for it really to run good with the 38.
Probably 95% of the people who want a weber should go with the 32/36.
Also all emission laws by the book require a visual inspection, it would fail as soon as they opened the hood. If you can find some place that will just sniff the tail pipe it is easy to get it to pass especially if the EGR and Cats are installed and working.
But technically no it wouldn't pass emissions.
