Twisted976 aka Joshua Alvey of Seymour, Indiana.

He does not answer my emails or phone calls. I bought something from him and he has kept my money without fulfilling his part of the deal.

Car enthusiasts shouldn't do this to each other. I just want him to at least give me the respect and call me back and not take the coward way out.

Thanks. To make a long story short I bought a car from him on eBay. I drove 6 hours to pick it up, took a day off work, and rented a car.. only to get there and find out the car has a blown tranny. He kept my paypal deposit saying he would return it in the next 2 days. It is 10 days later and he does not answer my emails or calls. I am disappointed, I thought he was one of the few good people left, especially among us car guys. Oh well... hopefully I can get some of my money back!

I bought a 1987 Oldsmobile Cutlass from Mr. Joshua Alvey via eBay auction number 120155358134 on September 2nd 2007. The winning bid was $2,500 US dollars. I sent him two separate paypal deposits of $500 each, making it a total of $1,000 dollar deposit. I then took the day off work on September 4th, 2007 and rented a car to drive to Seymour Indiana to pick the Cutlass up. I brought the remaining $1,500 dollars in cash. When I arrived, the car was not as described. Josh sent me two separate emails telling me the car had no rust and that the car was in great mechanical shape. The mileage on the car was rolled back, whether it was by Joshua, I do not know, but he told me the mileage was true at 46,000 miles when in reality according to carfax the car has over 98,000 miles. The car had a bad transmission when I test drove it, it would not shift out of first gear and was smoking badly from leaking transmisison fluid from the pan onto the exhaust. I immediately told Josh I did not want the car because it was not as described and I told him he could keep $200 dollars to cover his eBay fees, but that the car was not what he told me. He agreed and gave me my $1,500 cash back and said he could not get me the paypal deposit that day, but that he would send it to me the next day. I drove 6 hours back to Chicago and waited 24 hours, nothing came to me. I called him, no answer. 48 hours went by, I sent him an email, no answer. I left numerous phone messages and sent emails to him. On September 6th, 2007 he put the car again on eBay and then sold it for $1,700, I tried emailing him and calling him again to no avail. At that point I filed two claims with paypal for the two deposits of $500 each. Since that time, Joshua emailed me back on September 12th, 2007 saying he bought another car with my money eBay item #170143262412 and that all he had was $600.00 to give me back. We emailed back and forth and paypal tried to be a mediator, and then Josh stopped communication. I got an email from him on 10-1-07 where he stated he was a collections manager and he knew that even if I took him to small claims court, he would only have to pay me monthly and that he knew how to work the system. I have not heard from him since. His girlfriend and my girlfriend were both there on September 4th, 2007 and witnessed the transaction. I spent $380.00 total with renting a car, food, and gas to go to Seymour, Indiana plus I lost the $1,000 dollar deposit he has kept from me. He is ignoring me and I have no way to get in touch with him. I am helpless and really cannot afford to lose this kind of money when I did nothing wrong. Paypal is not helping me and I do not know what else to do. Your help is greatly appreciated.

I am trying to get him to small claims court here in Chicago and in Seymour, but I would like to solve this outside of the courts.

go to small claims court and sue him for the state max. He could be bluffing about being a collection manager besides laws are laws. Print off all emails that he has sent you and record all future conversations VIA phone. Take his ass to court and fry him. If you get a decision in court you can look into putting a lien on his home.

Really? Wow, I never new you could sue for more than what they owed.

Should I get a lawyer?

I have never sued anyone before, so this is all new to me.

i dont think it would be nessasary to get a lawyer for small claims. As far as suing for more then he owes, the reason behind that is because if he does not show for the court hearing then they will automatically rule in your favor. If he does show then the judge will only rule for the amount of damages caused. But you can also try to get the money for travel and the rent a car and the time off work as well. Its worth a shot

Well, this guy still has my money.

I filed a small claims case, let's see what happens.

In the meantime, Buyers Beware! Don't buy from this guy!! Liar and Thief are two words that come to mind...

Why dont you do a claim on paypal. They should return your money if it is still avail. I know i just got taken for a ride from some mini trucker in ohio who bought a chrome tank from me and there was a small flake of chrome peeling that i didnt see before i shipped it, and paypal paid him and he kept the tank so I am out a brand new tank...but thats just a heads up. By the way another bad note is even if you win you may never see the money small claims isnt a criminal court they wont force him into paying. Try paypal first file a police report of theft,fraud whereever that may lead then if they pick it up they can force him into paying if it is a criminal act which it could be. Then if they give him probation which they probably would he would be forced into paying a little each P.O visit.
