dude that's fucking shitty as hell. Too bad that you can't just pick her up and hold on to her out of fear of her mother. I'd probably find myself in jail for the way that I would handle things here. Keep up the good fight.

man thats real shitty of il, but its more and more common for these states to do that. you almost have to have some physical evidence of the marks and brusies for them to even care. but if you were to go take your daughter, they would probably try and charge you with kidnapping. crazy i know, my parents are still battling over my sisters kids. their fathers parents have custody of them. both house holds are a bunch of sore loosers that party all the time and do drugs (smoking pot and doing meth) right in front of the kids. where neither of mine do that. but they wont adjust the case for them to be able to see the kids like they are suppose to and neither of the sisters are allowed at the others house. its a crazy mess. they dont realize what kinda trama these kids are going through. really wonder whats going on in these court peoples heads, or is it they just dont care enough. hope it all works out for you bro, keep up the hard fight. im a true believer in "EVERYTHING HAPPENS FOR A REASON" no matter what the situation is, good, bad, ugly, awesome, theres a reason behind it happening, you may never find out why its happening but its all for a reason some way or another.

was sumers birthday, i was suppost to have her for half the day, and we agread upon 12 noon be the time back on wendsday,thursday comes and i get ready to leave to head up to ill.( 2hour drive)when i get a text saying "somethings comeup and im able to see sumer for the day or for the weekend" as the next day was my weekend as well...WTF...so i called and get no one..of course..well i go up anyways and go to the meeting place and wait..at 1130 i try again by texting and get the same thing..."no"...i try again and ask why not.."no".so i try again like this..WHY NOT.. "because i said no" i tell her she is breaking court order and i will call the cops..she says go ahead..so i did..they tell me that they cant do any thing till she has broke the order at 12..but not to get himself in trouble.. the officer said i should go and buy something at 12...then again at 1215 when she dont show to prove i was there..and she wasn't,after that i was told to come down to the HQ of the state police and file with them... so after the time rolls by and she dont show, we go over to the police station( drive into IL. another hour), talk to the officer there and he said he will try and call her and see whats going on...so he does and when he comes back out he says that she is telling him that her lawyer is telling her not to let me see or talk to sumer in anyway,and he said he told her that this is breaking the court order and there will be a citation sent to her by the officer,.. i called friday and made sure that they sent it and that she got it and they told me she had got it,i asked if i could do another one for breaking the visition for the weekend as well and said no thats not needed to just take it in front of the courts,..rest of the day i tryed to call or text and get nothing from my ex, saturday the same nothing,today still nothing

violations of court order time and time again..... ouch..... but this is fuel for the fire when it comes to establishing character.

Wow man I TOTALY feel your pain. I have not read all the post but what I have read sounds eerily similar to my situation back in the day. Unfortunately physical evidence is the only way DFS or whatever they are called will get involved. I fought the battle in the state of MO w/ the ex living in OK. I was lucky in that aspect because I filed for divorce in MO so that is where the case stayed...till now, I have moved it to MS. But the latest move is an entire different story.
Document absolutely EVERYTHING. If you are supposed to meet her do it. Even if she is not there. Call the cops if she is a no show and ask for a civil report. Basically it is the cop stating you were there she was not and no child exchange happened. I know in MO after several weeks of no contact you can file for Parental Kidnapping, this is hard to get a prosecutor to file though. However if you do get them to that is a felony most of the time. The other is not as severe but adds up over time, that would be to file for Interference With Custody.

Man I could type a novel here but that would be crazy. Lets say I spent a little over 3 years, over $25,000 but have had physical primary custody of my daughter for almost 7 years now. Trust me it was hard as ever and has not been a smooth ride afterwards but worth every bit of it. If you would like some more insight please do not hesitate to call me 601.500.2946 - Jeff

update..we have a court date set for july 11th,its just for breaking the court order but its a step
